As a dedicated New Jersey Divorce Lawyer, I am often asked by clients about how to divorce someone who lives in another state. If getting divorced in New Jersey and your spouse lives in a different state, you have to establish what's called jurisdiction here in New Jersey. That means you have to live here for a year beforehand. Under the statute you could file for adultery as a cause of action within less than a year of timeframe of filing. I have never done that, it's something I would be concerned about doing. The basic concept is you're going to get divorced in New Jersey. You're going to live here for one year, and you're going to satisfy all jurisdictional requirements, and then you can proceed, even if your husband or wife lives in a different state.
