How Long Does a Divorce Take to Complete?

WEINER LAWInsightsHow Long Does a Divorce Take to Complete?

Divorce Friday, July 21, 2017

As an experienced New Jersey Divorce Attorney, I know that one of the first things on a client’s mind is how long a divorce is going to take. In New Jersey, we have something called best practices, where they tell us – they being the administrative office of the courts and basically the legal world – they want it to be done in a year. Get this: You can get divorced in 24 hours or 48 hours. How is that even possible? What you would do is you would negotiate your property settlement agreement. That’s your contract. That means you’re going to be divorced. There’s going to be a section for alimony if there’s alimony, a section for child custody, child support, retirement, assets, personal property, and automobiles. Your complete document will be finished first before you file the complaint for divorce. Then if you’re able to negotiate that document first, then you can go into court and simply file it and get divorced.

Now, if you’re going through the regular routine of going through a divorce, as I said, it’s about a year that people try to focus and get this matter completed. However, again, it’s all fact-specific. If you have two people with two good lawyers that want to settle a case, you will settle the case, and the goal should be getting it done as soon as possible. The simple analogy now that I say to people is it’s like a root canal. There’s only one good thing about it: when it ends.
